NOTICE OF PUBLIC HEARING BY THE SHELBYVILLE BOARD OF ZONING APPEALS
Notice is hereby given that the Shelbyville Board of Zoning Appeals will hold a Public Hearing
on Tuesday, July 8, 2025 at 7:00 PM in the Common Council Chambers at Shelbyville City
Hall, 44 W Washington Street, to consider four petition(s):
● BZA 2025-07: A petition by Brad Kendall of Van Trust Real Estate for three
Development Standards Variances from UDO 5.15-B, Non-Residential Drive
Standards, at the property located at 1100 Mausoleum Road.The request is to allow a
width increase of three drive entrances from the allowable 36 feet to 42 feet on
each drive. This petitioner also seeks two Development Standards Variances from
UDO 2.28 General Industrial (IG) District Development Standards to allow two
accessory structures to exceed the maximum permitted height (50% of the primary
structure) by 18 inches each.
● BZA 2025-08 A petition by Leah Knight for four Development Standards Variances
from UDO 5.03, C-4 Yard Locations, in a Single-family Residential (R1) District, at the
property located at 1931 S. Riley Hwy..The first request is to allow an accessory
structure to be located in the front yard. The second request is to allow a variance of
UDO 2.08 front yard set back on Morrison St to be reduced from 20 to 16 feet. The
third request is to allow the front yard set back on Riley Pl to be reduced from 20 to
8 feet. Lastly, this petitioner also seeks to allow the accessory structures to exceed
the maximum permitted height (75% of the primary structure).to 19 feet.
● BZA 2025-09 A petition by Dustin Myers of Crossroads Engineers, on behalf of St.
Joseph Catholic Church for nine Development Standards Variances, at the property
located at 125 E. Broadway.
The requested variances are from the following sections of the Unified Development
Ordinance:
o UDO 5.03-AS-02-I-2: Dumpster and Trash Containers (Front Yard)
o UDO 5.15-A: Non-residential Driveway Standards, Separation (E. Broadway St)
o UDO 5.15-A: Non-residential Driveway Standards, Separation (S. Pike St)
o UDO5.55,SB-01, I-4,A Setback Standards, Parking Lots (Broadway St)
o UDO5.55,SB-01, I-4,A Setback Standards, Parking Lots (Pike St)
o UDO5.55,SB-01, I-4,A Setback Standards, Parking Lots (Hendricks St)
o UDO5.55,SB-01, I-4,A Setback Standards, Parking Lots (Center St)
o UDO5.55,SB-01, I-4,A Setback Standards, Parking Lots (Alley)
o UDO5.55,SB-01, I-4,A Setback Standards, Parking Lots (Noble St)
● BZA 2025-10 A petition by Eric Glasco of Stephen Rife, on behalf of Custom
Manufacturing Enterprises, requests a Special Exception Use Variance from UDO
2.25 Light Industrial (IL) District for the property located at 1110 Hale Rd, to allow the
use of “Truck/Trailer Sales and Service” on the subject property.
● BZA 2025-11 A petition by Andrew Nance for one Development Standards Variance
from UDO 5.03-C-4, in a Single Family Residential (R1) District, at a property located
at 1930 Culbertson Road. The requested variance is to allow the placement of an
accessory structure, specifically an inground pool, in a “Front Yard” due to the
subject property being a through-lot where both the east and west sides of the
parcel are considered “Front Yards”.
The application may be examined at the office of the Plan Commission of the City of
Shelbyville, Indiana in City Hall located at 44 West Washington Street, Shelbyville, Indiana,
46176, Monday through Friday between the hours of 8:00 AM and 4:00 PM. We encourage
residents to view project information through the “Agenda Portal” on the City’s website at
https://www.shelbyville.in.gov/agendacenter. City Staff will post documents to the website
as they are completed and/or received.
Written comments in support of or in opposition to the petitions may be emailed to
arude@cityofshelbyvillein.com or mailed to the Plan Commission Office (44 W. Washington
Street, Shelbyville, IN, 46176) or filed with the Plan Commission Secretary at the Public
Hearing and will be entered into public record and considered by the Board of Zoning
Appeals at the hearing.
Public Hearings are open to the public and public comment will be heard at the meeting.
The meeting will also be streamed via the City’s Facebook page and via Zoom; a link to the
City’s Facebook page is available on the homepage of the City of Shelbyville’s website and
the Zoom link has been included below. Public Comment will be taken in person and
virtually via zoom. Any member of the public that wishes to provide public comment on a
petition must contact the Plan Commission Secretary no later than 24 hours prior to the
meeting pursuant to Board of Zoning Appeals Res. 2021-01. The request to participate
electronically must be sent in writing to arude@cityofshelbyvillein.com and include:
a. Names of all individuals who desire to participate via electronic communication;
b. Email addresses for each individual identified above;
c. Date and time of the meeting;
d. Reason for participation (agenda item);
e. Any materials the member of the public would like the Board of Zoning Appeals
members to have at the meeting; and
f. If the member of the public is also the Petitioner in front of the Board of Zoning
Appeals, identify one person who will appear in person.
